This Privacy Policy explains how muukly ("we" or "us") collects, uses, discloses, and protects information about you when you use the muukly platform (our website, app, and related services) (collectively, the "Service"). It also describes your rights and choices regarding your information. By using muukly, you acknowledge that you have read and understood this Privacy Policy.

In summary, muukly is a platform that lets you interact with an AI (powered by third-party Large Language Models) to get answers and generate content. To provide this Service, we need to collect and process some data about you and how you use muukly. We are committed to handling your data responsibly and in compliance with applicable laws.

Note: muukly is currently in an MVP/Beta stage, and as such some data practices may evolve as the Service develops. We will update this Policy as needed to reflect changes. We will not use your personal information in new ways without informing you as required.

Information We Collect

We may collect personal data and other information from and about you in a few different ways:

1.1 Information You Provide Directly

  • Account Information: If you create an account on muukly, we may collect information such as your name, username, email address, and password. This is used to set up and secure your account. (Note: during the beta, account creation may be optional or limited.)
  • Profile Data: If you choose to create a profile or provide other details (such as an avatar, bio, display name), we will collect the information you provide for that profile.
  • Communications with Us: When you contact us (for example, via customer support emails or feedback forms), we collect the information you send us (email address, the content of your message, and any attachments or screenshots).
  • Content You Provide (Prompts and Files): The core of muukly is that you input prompts or questions to the AI. We collect the text or data you submit in your prompts, as well as any files or images you choose to upload to muukly as part of using the Service. This Input content is necessary for us to send to the AI model and return an answer. It may also be stored on our systems to enable features like chat history or to improve the Service. Please do not include sensitive personal information in the content you provide.
  • Feedback and Surveys: If we ask you to participate in user testing, beta surveys, or provide feedback to improve muukly, any information you provide (responses, opinions, suggestions) will be collected. Participation in such research is voluntary, and we will anonymize data in our analysis whenever feasible.

1.2 Information We Collect Automatically

When you use muukly (whether or not you have an account), we and our third-party partners may automatically collect certain technical and usage information. This includes:

  • Device and Usage Data: We collect data about how you access and use our Service, such as your IP address, browser type, device type, operating system, referring URLs, pages viewed, and the dates/times of access. For example, our servers log when you visit muukly, what pages or features you interact with, and how long you spend. We may also collect device identifiers or mobile IDs if you use a mobile app. This information helps us administer the Service, diagnose technical issues, and understand user engagement.
  • Cookies and Similar Technologies: We use cookies and similar tracking technologies (like web beacons, pixels, and local storage) to collect information about your use of muukly. Cookies are small text files placed on your device that help websites operate and gather data. For example, we may use cookies to remember your preferences (such as language or theme settings), keep you logged in, or analyze site traffic. Some cookies are necessary for the Service to function, while others are optional analytics cookies (see our Cookie Policy for details). We may also utilize third-party analytics tools (like Google Analytics) that set cookies to collect usage statistics (e.g., pages visited, actions taken, how you arrived at our site). You have choices in managing cookies, which we discuss in the Cookie Policy and Your Choices section of this Policy.

1.3 Information from Third Parties

We may receive information about you from third parties in some situations:

  • Third-Party Account Login: If in the future we allow account sign-in via third-party platforms (for example, "Log in with Google" or similar), we would receive certain information from that third party (such as your name and email associated with the external account) to authenticate you. We will only collect the details necessary for login and account identification.
  • Service Providers: We might receive information from service providers we work with, such as payment processors or analytics companies. For example, if you make a purchase, our payment processor will convey whether payment was successful (but not your full card details). Or analytics tools might provide aggregated information about usage.
  • AI Provider: Our third-party AI model provider (OpenAI or others) may receive your prompts and provide the resulting AI output. Generally, the provider does not send personal data back to us, but in processing your query, they may log certain usage data on their side. We do not receive personal information from the AI provider beyond the content of the AI's response.
  • Public Sources: We do not actively collect data about individuals from public databases or social media in the normal course of offering muukly. All personal data we process is primarily collected from you or your device use, except in cases like anti-fraud checks or legal compliance where we might consult external sources.

Special Note – Sensitive Data: We ask that you do not provide any sensitive personal information via muukly. Specifically, do not include personal health information, financial account numbers, government-issued identifiers (like social security numbers), racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, precise geolocation, or data concerning your sex life or sexual orientation in any prompts or uploads. muukly is not intended to process such data, and including it in your inputs is against our guidelines. If you choose to disregard this and input such data, you acknowledge that you are doing so at your own risk, and we will treat it as regular user-provided content (which may be transmitted to the AI provider). We will not be liable for any exposure of sensitive data caused by your inclusion of it in the Service contrary to this warning.

How We Use Your Information

We use the collected information for various purposes consistent with providing and improving our Service and as permitted by law. The primary purposes for which muukly processes your data include:

To Provide the Service: We use your information to operate muukly and provide you with the functionality you expect. For example, we use your prompt input to generate AI responses and deliver them back to you. We use account data to authenticate you and personalize your experience (e.g., showing your chat history or preferences). Without processing your data, we cannot offer the core muukly Service. This processing is generally based on fulfilling our contract with you (i.e., our Terms of Use) or our legitimate interest in providing a working service.

To Improve and Develop the Service: We analyze usage information, feedback, and aggregate user interactions to understand how muukly is used and how we can make it better. This helps us troubleshoot problems, optimize AI model performance, and develop new features. For instance, we might review (either manually or via automated tools) some anonymized prompts and outputs to improve our AI's accuracy and safety, or to refine our user interface. We might also use A/B testing or analytics to see which features are popular. We take steps to anonymize or pseudonymize data wherever feasible when using it for improvement and research, and we process it under our legitimate interests in enhancing our services (balanced with your rights).

To Communicate with You: We may use your contact information (like your email) to send you service-related communications. These include confirmations, technical notices, updates, security alerts, and support messages. For example, if you sign up, we might welcome you or send notices about policy updates or changes to muukly's features. If you contact us with a question, we will use your contact info to reply. In some cases (if you have opted in), we may send promotional communications about new features or beta opportunities, but you will have the ability to unsubscribe from marketing emails at any time. Communications are sent either because they are necessary to perform our contract (service notifications) or based on consent/legitimate interest for marketing (with compliance to opt-in laws as required).

To Enforce Policies and Prevent Misuse: We use data to keep muukly safe, secure, and in compliance with our Terms. This includes monitoring for fraud, abuse, and violations of our Acceptable Use rules. For instance, we may analyze logs or content to detect spam or malicious behavior, verify that use of the Service is not violating third-party rights or laws, and ensure the AI isn't being misused. If we detect potentially illegal activity or content that violates our policies, we may investigate and take appropriate action (which could involve reviewing relevant user data and sharing data with law enforcement where legally required). This processing may be under legal obligations (to prevent illegal activities) or our legitimate interest in maintaining a safe platform.

For Legal Compliance: We may process and retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. For example, we might keep logs as required by regulations, or use your data to comply with lawful government requests or court orders. We also may use data to exercise or defend legal claims.

We do not use personal data for any purposes that are incompatible with the above, and we do not sell your personal data to third parties for monetary consideration.

Legal Bases for Processing (for users in the EEA/UK/etc): If you are in a jurisdiction that requires a legal basis for data processing (e.g., under GDPR), our legal bases include: performing the contract with you (Terms of Use) for providing the Service, legitimate interests (in running, improving, and securing our Service, in line with what is expected from an AI platform), compliance with legal obligations, and your consent where applicable (for example, for certain marketing communications or cookies). We always strive to ensure that we only process personal data for which we have a valid legal basis and that we consider your privacy rights in everything we do.

How We Share or Disclose Information

We understand that your information is important, and we only share personal information in a limited set of circumstances, as described below. We do not sell or rent your personal information to third parties. We may share your information in the following ways:

3.1 Third-Party AI Provider

As the core function of muukly, we share the content of your prompts (and any data needed to generate a response) with our third-party AI model provider (e.g., OpenAI). This is necessary to obtain the AI-generated responses you request. The AI provider will receive your Input (which may include text and any attachments you submit) and process it to generate an Output. We do not share your account identity (such as your name or email) with the AI provider in this process, unless it is technically necessary for certain features (for example, in a future multi-user group chat, the AI might be given user names just to distinguish speakers; currently, muukly does not have such a feature). The AI provider may also record logs of the content it processes and the outputs it generates for monitoring and improvement of their own services, under their own privacy and data retention policies. By using muukly, you consent to this sharing of your content with the AI provider for the purpose of obtaining AI services. If you do not want your information shared with the AI model, please do not use muukly to input that information.

3.2 Service Providers

We may share personal information with third-party service providers and vendors who perform functions on our behalf to support the Service. These include, for example:

  • Hosting and Infrastructure: Companies that provide cloud hosting, data storage, and server operations for muukly (ensuring our website and databases run reliably). They may process your data as part of storing it or making the Service available.
  • Analytics Providers: As noted, we might use third-party analytics (like Google Analytics or similar) to understand usage. These providers may set cookies or use tracking tech on our site and collect usage data and device identifiers. We only receive aggregated or de-identified insight from them in most cases, but they process your data for our purposes.
  • Email/Communication Services: Services that help us send transactional emails, support messages, or newsletters (if you subscribed). They would handle your email address and the content of the communication.
  • Payment Processors: If we offer paid features or subscriptions in the future, we will use third-party payment processors (e.g., Stripe, PayPal) to handle payment transactions. Your payment details (credit card number, etc.) go directly to them; we generally do not receive or store full payment card info. We may get basic info like billing name, payment method, and confirmation of payment.
  • Security and Fraud Prevention: Services that help us detect and prevent malicious or fraudulent activity (such as DDoS protection services, captcha providers, or tools that detect abusive content). These providers may process IP addresses or user activity data to filter out bad actors.

These service providers are contractually bound to only use your data as needed to perform the services for us and not for their own unrelated purposes. We require them to protect your personal information with appropriate security measures.

3.3 Within Our Corporate Group

If muukly is part of a group of related companies (affiliates, parent, or subsidiaries), we may share personal data with those affiliated entities for purposes consistent with this Policy. (As of the MVP stage, muukly’s corporate structure may be simple, but this is noted for completeness.) Any internal sharing would still honor the commitments made here.

3.4 Business Transfers

If muukly (or its business or assets) is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale transaction, your information could be disclosed or transferred to the relevant third party (e.g., the acquiring entity or its advisors) as part of that process. We would ensure that any such party is bound to respect your personal data in a manner consistent with this Policy. If a change of ownership occurs, we will provide notice to users as required by law and/or seek your consent where required.

3.5 Legal Compliance and Protection

We may disclose your information if required to do so by law or if we have a good-faith belief that such action is necessary to: (a) comply with a legal obligation, such as a lawful subpoena, court order, or law enforcement request; (b) protect and defend the rights, property, or safety of muukly, our users, or others; (c) investigate or assist in preventing any violation of law or our Terms of Use; or (d) respond to an emergency that we believe in good faith requires us to disclose information to assist in preventing a death or serious bodily injury. We will attempt to notify you of legal demands for your data when appropriate (for example, if a court order allows us to do so) and legally permissible.

3.6 Aggregate or De-Identified Information

We may also share information that has been aggregated (combined with information of other users) or de-identified (stripped of personal identifiers) such that it cannot reasonably be used to identify you. For example, we might publish blog insights like "X% of muukly users asked about topic Y" or share statistics with partners about general usage patterns. Such information would not personally identify any individual and may be used freely for our business purposes.

We do not disclose personal information to third parties for their own direct marketing purposes without your consent.

Data Transfers

muukly is operated in Romania. Your personal data may be stored and processed in servers located in that country, or in any other country where our service providers maintain facilities. This means your information may be transferred to and stored in a jurisdiction different from your home country. For example, if you are located outside the United States, your data may be transferred to the U.S. (where many tech service providers are based) or other jurisdictions which may have data protection laws that are different or less protective than those in your country.

If you are in the European Economic Area (EEA), UK, or Switzerland: when we transfer personal data out of these regions, we will do so in accordance with applicable data protection laws. This typically means we will rely on appropriate safeguards, such as Standard Contractual Clauses (SCCs) approved by the European Commission, or ensure the recipient country has an adequacy decision, or obtain your consent for the transfer, as needed. We will take steps to ensure that your information is treated securely and in accordance with this Privacy Policy wherever it is processed.

By using muukly, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy.

Data Retention

We will retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, as described in this Policy, or for as long as required by law (for example, for legal, tax, or accounting purposes).

If you have an account, we generally retain your account information while your account is active and for a reasonable period afterward in case you decide to reactivate, or as needed to comply with legal obligations.

Content like prompts and outputs may be stored to enable your access to past conversations and to improve the Service. In beta, we might retain conversation data indefinitely until we implement a deletion schedule. We will update you of any retention limits or allow you to delete specific content.

Even if we delete your data, it may persist in backup archives (but will be securely protected) for a short period. We also may retain certain information in aggregated or anonymized form.

We aim not to keep personal data in identifiable form for longer than necessary. When we no longer have a legitimate need to retain your data, we will securely erase or anonymize it.

Your Rights and Choices

Depending on your jurisdiction and applicable law, you may have certain rights and choices regarding your personal information. We are committed to enabling these rights. These may include:

  • Correction (Rectification): You have the right to request that we correct or update any inaccurate or incomplete personal information we hold about you. You can also update some of your account information directly in your profile settings (if applicable).
  • Deletion (Erasure): You have the right to request that we delete your personal data. For example, you can delete your account if one exists (which will remove your profile information). You can also contact us to request deletion of specific data (subject to certain exceptions where we have to keep data, e.g., for legal compliance or legitimate interests such as security).
  • Withdrawal of Consent: If we are processing your personal data based on your consent, you have the right to withdraw that consent at any time. For instance, you can opt out of marketing emails by using the unsubscribe link in those emails or adjusting your account settings. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
  • Automated Decision-Making: muukly does not make any decisions about you that have legal or similarly significant effects solely by automated means without human involvement. The AI outputs you receive are automated, but they are not decisions about you; they are responses to your queries. However, if you believe you have been subject to automated decision-making in a problematic way, you have the right to request human review.

To exercise any of these rights, please contact us. We will verify your identity (to protect your privacy) and respond to your request within the timeframes required by law. Note that these rights are not absolute - they can be subject to conditions or limitations. For example, we might not delete data we are legally required to keep, or we may refuse a request if it endangers the privacy of others or our legitimate interests (we will explain our reasoning in such cases).

Your Choices - Profile and Content: You may review and update certain information via your account settings if applicable (e.g., change your email or password). You can also delete your chat history or specific prompts if that feature is provided. We encourage you to use available controls to manage your data within the Service.

Cookies and Tracking: For choices related to cookies and similar technologies, see our Cookie Policy below. Most browsers let you remove or reject cookies; doing so may affect core functionality (like staying logged in), but is your choice. Our Cookie Policy provides more detail on how to adjust your preferences.

Do Not Track: Some browsers have a “Do Not Track” (DNT) feature that, when enabled, signals websites that you do not wish to be tracked. There is currently no industry consensus on how to interpret DNT signals, and muukly does not respond to DNT signals. We instead adhere to the privacy standards described in this Policy and provide the choices stated herein.

Opt-Out of Marketing: As noted, if we send you marketing communications, you can opt out at any time. Use the “unsubscribe” link in any promotional email or contact us to be removed from our mailing list. Transactional or service messages (like account notifications) are necessary and are not subject to general opt-out unless you stop using our Service.

Security

We take reasonable and appropriate measures to protect the security of your personal information. This includes implementing technical, administrative, and physical safeguards to prevent unauthorized access, use, or disclosure of data. For example, we use encryption to protect data in transit (HTTPS for our website) and encryption at rest for stored data where applicable. We restrict access to personal data to authorized personnel and contractors who need it to operate, develop, or improve the Service, and they are subject to confidentiality obligations.

We also continually work to update our security practices to ensure your data is handled safely. We monitor for possible vulnerabilities and attacks, and we may anonymize or pseudonymize data to protect your privacy when possible. Additionally, we have measures in place to detect and respond to potential data breaches.

However, it's important to note that no method of transmission over the Internet, and no method of electronic storage, is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. You should also take steps to secure your own account and data, such as choosing a strong password and keeping it confidential, and logging out of the Service when you're done, especially on shared devices.

Children's Privacy

muukly is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 (or under the relevant age of digital consent in your jurisdiction). If you are under 13, do not use muukly or provide any personal data to us. If we become aware that we have inadvertently collected personal information from a child under 13 without proper consent, we will take steps to delete that information. Parents or guardians who believe that muukly might have collected data from their child can contact us to request deletion.

International Users

As noted in Data Transfers, your information may be transferred to and processed outside of your country of residence, including in countries that may not provide the same level of data protection as your home country. By using muukly, you acknowledge this.

If you are using muukly from the European Union, United Kingdom, or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your personal data to muukly’s servers and to third parties as described. We will take all steps reasonably necessary to ensure that your data is treated securely in accordance with this Policy.

Third-Party Links and Services

muukly may contain links to third-party websites or services, or incorporate third-party offerings (for example, links in AI-generated answers might point to external sources, or we might integrate a third-party plugin or tool). This Privacy Policy does not apply to information collected by third-party websites or services, which have their own privacy practices. If you follow a link to any third-party site or service, or engage with a third-party content through muukly, we encourage you to read the privacy policy of that third party. We do not control and are not responsible for the privacy practices of any third-party entities that are not operating as our service providers under contract.

Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. If we make a material update, we will provide prominent notice (e.g., on our website or via email notification) to inform you of any significant changes. We will also update the "Last updated" date at the top of this Policy.
